Laws against “ticket scalping,” good or bad?

Which of the following statements is true?

Ticket scalping is bad and should be outlawed because ticket scalpers are people who just got lucky  when they bought highly sought after tickets at face value and then sold them for an obscene high price to someone who wasn’t lucky.  The ticket scalper doesn’t deserve a windfall profit just because someone else wasn’t as lucky as he was.

Or,

Ticket scalping is good because it is a voluntary exchange that allows someone who either wasn’t lucky enough to get a ticket at its face price or just didn’t want to stand in line for hours to get a ticket to a sporting event or concert they want to attend.  It is also an exchange that, being voluntary, is made only when both parties to the transaction get what they most value.
