Obama’s remarks are mostly lies, as usual, such as calling it “unprecedented and extraordinary” that the Supreme Court would ever declare a law enacted by Congress to be unconstitutional. He knows he’s talking turkey, he used to teach Constitutional law for goodness sake. The first case law students read in their Constitutional law class is Marbury v. Madison, the 1803 case in which Chief Justice John Marshall established the precedent for judicial review by the Supreme Court of laws passed by Congress. Yes, it’s that basic of a precedent and Obama’s remarks today to the contrary are that dumb.
Except for having the right “skin in the game” Obama wasn’t much of a star at the University of Chicago during his tenure there as a Constitutional law professor. This post at Charles Rowley’s blog, A Failing Grade On Barack Obama From the University of Chicago School of Law paints Obama as quite mediocre and not much respected by other faculty.
Obama complains that the Justices are “unelected.” That’s a fact we all know, it’s not an argument against them exercising judicial functions and deciding cases on the basis of legal principles. Their unelected status is only an argument against them using their judicial post to impose matters of public policy on us because that is the province of our elected representatives. If we don’t like the policies our representatives make we can vote them out of office. Obama is in no position to complain about unelected officials when he has appointed some 35 “czars,” all of whom make public policy decisions that we are forced to live under and none of whom is elected or even subject to Senate ratification of the their appointment. People who live in glass houses, Mr. Obama, you know what we mean?
He also referred to Obamacare as a law passed by an “overwhelming majority” of a Democratically elected Congress. It’s not in this video but I swear I’ve heard an audio clip of him saying it was passed by a “bipartisan majority.” No, it was not. No Republican in either the House or Senate voted for it and 34 Democrats in the House voted against it. It passed the House buy a mere 7 votes. [There are 435 members of the House].
If the Justices are to follow politics instead of legal Constitutional principles, as Obama seems to want them to do, then instead of taking instruction from a fabulist president perhaps they should look to the public opinions polls which show that a majority of Americans are opposed to Obamacare and want it repealed.
The Fifth Circuit Court of Appeals has taken umbrage at Obama’s remarks and has ordered the U.S. Justice Department to clarify. See also, Why is Obama so Rattled? at Investors’ Business Daily.
Well, we know that Obama is a narcissist and he gets angry at anyone who fails to properly celebrate the pageantry of his life, be it the Justices on the Supreme Court or anyone else. Of course, the secret service agents who protect Obama are professionals dedicated to duty and country and would never publicly criticize any president they are sworn to protect, but sometimes secret service secrets do leak out.
